Introduction

As you may be aware, OSHA requires Bloodborne Pathogen training in many industries, and covered employees include janitors, food service workers, medical staff, hairdressers, and any other employee that could conceivably be faced with a blood spill in the course of their employ- ment. Penalties and fines levied by OSHA have been significant in this area, and are severe enough to threaten the close of businesses. The litigation risks are potentially catastrophic, as a terminal illness caught by an employee because Federal regulations were not followed would likely yield a significant damage award.

Additionally, many states and municipalities are adopting requirements for training in Cardio-Pulmonary Resuscitation (CPR) and Automated External Defibrillation (AED). Defibrillators have dramatically increased the save rate for heart attack victims when one is available within five minutes of the attack. While AED training has not yet been fully codified into Federal law, many states, municipalities, and agencies are adopting mandatory AED programs. The litigation risks for non-compliance in this area are equally significant.
